This agreement is concluded between Borisstudio.com (hereinafter – the Site Administration) — the company providing services and access to the website Borisstudio.com (hereinafter – the Site), and a private individual visiting the site pages or using at least one of the services provided within the site (hereinafter – the Site Visitor). The Agreement defines the procedure for using the resources, services, and features of the site provided by the Site Administration as a platform for receiving and posting information.
1.1. The User has the right to:
1.1.1. Leave comments on posts;
1.1.2. Use site materials only for personal non-commercial use, provided that copyright and property rights are respected. It is prohibited to fully or partially distribute, copy, or demonstrate materials posted on the site. It is also forbidden to use site materials in any other way for public or commercial purposes. Any use of materials posted on the site on other websites or in computer networks is prohibited.
1.2. Copyrights for the resources, services, and materials of the site belong to the Site Administration. The exception is if another source is indicated as the copyright holder.
1.3. Copying site materials without written confirmation of the Administration’s consent is prohibited.
1.4. You may use partial citations of site materials (no more than 5% of the total volume of the material) on an irregular basis with a mandatory link to the source page of the quote.
1.5. All names, titles, trademarks, symbols, and slogans registered in the prescribed manner are the property of their respective owners. The icons ® and/or ™ are not used in the site materials to designate them.
2.1. When writing comments, the user is obliged to follow the established rules and restrictions.
2.2. Ignorance of the rules, as well as restrictions on the placement of information and the use of site resources, does not exempt the site user from complying with them, and in case of their violation – from liability in accordance with the terms of this Agreement and the legislation of Ukraine.
2.3. The following is prohibited on the site:
2.3.1. Use of comments for purposes other than intended (for example, for advertising third-party services or for the purpose of asking questions to other site visitors);
2.3.2. Offensive behavior towards other users and representatives of the site Administration;
2.3.3. Publication of obscene language;
2.3.4. Publication of messages aimed at provoking a negative, aggressive, or irritated reaction from other site users;
2.3.5. Placement of unauthorized advertising, commercial messages, or announcements;
2.3.6. Placement of materials containing insults or signs of discrimination based on national, ethnic, racial, or religious affiliation;
2.3.7. Unauthorized placement by the user of materials to which the copyrights belong to third parties;
2.3.8. Promotion of computer and audio/video piracy in any form, as well as publication of links to files and/or sites that clearly violate or contribute to the violation of third-party copyrights;
2.3.9. Publication of calls for the violent change or overthrow of the constitutional order, seizure of state power; for changing the state border of Ukraine; for riots, destruction of property, seizure of buildings or structures; for aggression or provocation of military conflict; other actions and publication of any messages prohibited by the legislation of Ukraine;
2.4. The writing of comments devoid of any information load and not related to the theme of the resource is not welcomed on the site.
3.1. Within the site, users are provided with a platform for communication (commenting system). Any site user can express their opinion on the topics of the site.
3.2. Responsibility for the accuracy of information posted in comments rests solely with its author.
3.3. Public sections of the site (comments) undergo post-moderation – checking by a moderator (an authorized representative of the Site Administration) after the messages are posted.
3.4. The Site Administration has the right to terminate the Agreement with the user at any time, including if the user has violated any provision of the Agreement or committed actions that clearly indicate that the user does not intend to or cannot comply with the provisions of the Agreement.
3.5. In case of violation of the terms of this provision by the user, the moderator has the right to delete the posted information and/or comment; block the user’s access to the site or completely exclude access to part of the site’s features by IP address.
3.6. A clearly and adequately reasoned appeal against the actions of moderators is possible through communication with the Site Administration.
4.1. The procedure for collecting, using, and disclosing information that may be considered confidential is carried out on the basis of the Confidentiality Agreement.
4.2. By accepting the terms of this Agreement or visiting the site pages, the visitor automatically agrees to the terms of the Confidentiality Agreement regarding the use of personalized and non-personalized confidential information.
4.3. The collection, storage, use, processing, and disclosure of information obtained by the site Administration as a result of a private individual visiting its sites and/or filling out registration forms, including users’ personal data, is carried out by the site Administration in accordance with the legislation of Ukraine. The private individual (user) clearly realizes all actions and gives consent to the collection and processing of their personal data by the site Administration within the scope and for the purpose provided for by the terms of the User Agreement and the Confidentiality Agreement in accordance with the legislation of Ukraine.
5.1. The site Administration treats the confidential information of any person who has become a visitor to this site with respect and responsibility. By accepting this Agreement, the User gives consent to the collection and use of certain information about the User in accordance with the provisions of the Law of Ukraine “On Protection of Personal Data” and the Site Administration’s policy on the protection of personal data. In addition, the user agrees that the Site Administration may collect, use, transfer, process, and maintain information related to the User’s membership for the purpose of providing relevant services.
5.2. The Site Administration undertakes to collect only that personal information that the Consumer provides voluntarily in cases where the information is needed to provide (improve) services to the Consumer.
5.3. The Site Administration collects both basic personal data, such as first name, surname, patronymic, contact phone number, and email address, as well as secondary (technical) data – cookies, connection information, and system information.
5.4. The User agrees that the confidentiality of data transmitted over the Internet is not guaranteed if access to this data is obtained by third parties outside the zone of technical means of communication controlled by the Site Administration; the Site Administration is not responsible for damages caused by such access.
5.5. The Site Administration may use any information collected through the Site for the purpose of improving the content of the website, its refinement, transferring information to the User (upon request), for marketing or research purposes, as well as for other purposes that do not contradict the provisions of the current legislation of Ukraine.
5.6. The period for which your personal data will be stored is the time necessary to use the data for the main activity of the Site.
5.7. You have the right to:
5.7.1. The ability to change your personal data if it is incomplete and/or incorrect.
5.7.2. Request for the deletion of your personal data.
6.1. To make your visit to the site more convenient, track site visits, and improve service, we collect a small piece of information sent from your browser, so-called cookies. If you wish, you can choose not to send cookies (please refer to your browser settings to find out how to do this). However, please take into account that disabling the cookie sending function may limit your ability to use the site.
7.1. The Site Administration bears no responsibility for any errors, typos, or inaccuracies that may be found in the materials contained on this Site. The Site Administration makes all necessary efforts to ensure the accuracy and reliability of the information on the Site.
7.2. Information on the Site is constantly updated and may become outdated at any time. The Site Administration is not responsible for the receipt of outdated information from the site, nor for the User’s inability to receive updates to information stored on the Site.
7.3. The activities of the site Administration are conducted in accordance with the legislation of Ukraine. Any claims, disputes, and official appeals will be considered exclusively in the manner provided for by the legislation of Ukraine.
7.4. The Site Administration bears no responsibility for the statements and opinions of site visitors left as comments. The editorial opinion may not coincide with the opinion and position of the authors of the comments. At the same time, the Site Administration takes all possible measures to prevent the publication of messages that violate current legislation or moral norms.
7.5. The User agrees that they are solely responsible (and that the site Administration is not liable to the user or any third parties) for any breach by the user of their obligations established by this Agreement, as well as for all consequences of such breaches (including any loss or damage that the site Administration may incur).
8.1. This Agreement is a contract. The Site Administration reserves the right to both change this Agreement and introduce a new one. Such changes take effect from the moment they are posted on the Site.
8.2. This Agreement enters into force upon the User’s first visit to the Site and remains in effect between the User and the Company throughout the entire period of the User’s use of the Site.
8.3. This Agreement is governed and interpreted in accordance with the legislation of Ukraine. Matters not regulated by the Agreement are subject to resolution in accordance with the legislation of Ukraine.
